In the state of Minnesota you have 30 days to Answer the Divorce Petition. What traits should I look for in a divorce attorney?

A great divorce attorney is someone who is patient, kind, knowledgeable about the divorce process, knows the laws surrounding divorce and can connect you with other professionals that you will need to work with throughout the process.

Will I be able to keep my house after the divorce?
Being able to keep the house after a divorce depends entirely on your financial health. Are you able to make the mortgage payment and also pay the utilities and upkeep of the home with your income alone? Does your legal spouse care if you take the house? Can you afford to pay out your legal spouse and the equity that they have put into the home? These are all questions that you can discuss with your divorce attorney to determine if it's realistic if you will be able to keep the home after the divorce.

How do we determine a parenting time schedule for the children during the divorce?
There are a number of parenting time schedules that people can choose from to utilize after their divorce. Some examples include a 5-2-2-5, where one party has the child for five days at a time, then the other party has them for two, then the first party has them for two days and the second parent has them for five days, and they constantly rotate the children this way. Ask one of our experienced attorneys to provide you with some common schedules for you to look through. The parenting time schedules are usually agreed upon by both parties during the divorce process.

How much will my divorce cost?
Every divorce is different. Unfortunately there is no "one size fits all" approach for a divorce. There are factors that can limit the cost of your divorce including: Can the parties agree on how their assets and debts will be split? Can the parties agree on the value of their homestead or do they need an appraisal? Can the parties agree on a parenting time schedule or do we have to submit the issue to the Judge to decide? Divorces start at $3,500.00 and can cost as much as $15,000.00+ depending on the facts of your case. How does a Retainer work?
At our law office we require all clients pay a Retainer Fee. This means that we require an up-front payment from our clients that we hold in a separate trust account. When we do work for our clients, we bill against the funds in their trust account. We then provide our clients with an accounting on the first of the month via email so they know exactly how much money they have in their trust account. We work entirely off of Retainer Fees because we don't have to wait to receive payment throughout the pendency of the case and we can do work more efficiently for the client.
